International aspects of business law Essay Example | Topics and Well Written Essays - 2500 words
International aspects of business law - Essay Example There are three categories of corruption cases, which can be political, personal or commercial in nature, but the basic difference lies in the office, authority and position, which are neglected, and intent of manipulations. Further there is political corruption, which may include bribery, use of governmental offices for private enrichment and changing of how decisions are made by public bodies (Heidenheimer, Johnston and Le Vine 1989). On the other hand, bribery is an act of corruption that entails obtaining money or any form of monetary gain, or the making of payments illegally through abuse of public or commercial office and funds. This payment does not necessarily involve the exchange of money, but can also be through gifts, special favours or influence and despite the form it takes, corruption is always a transaction that goes in two ways involving two parties that is the briber and the one who receives the bribe. In relation to the case study Mullet Inc. though incorporated in US intends to secure a contract to supply computers to Central Bank of Acacia, however it is faced with the challenge of contravening international business laws on corruption and bribery by giving the board of directors a celebratory dinner for it to secure the contract. The payment of this dinner is a form of bribery to the board members by the negotiating team for them to accept to continue and finalize the business contract. This paper will seek to advise the Mullet Inc. negotiating team of their legal liabilities by giving in to the Chairman of the Acacia bank demands under US FCPA in comparison to the UK Bribery Act. The U.S. Foreign Corrupt Practices Act This Act of 1977 outlaws American corporations from making any payment deemed as bribery or inducements to overseas representatives with the intent of winning or keeping business (U.S. Department of Commerce 2004). This statute was enacted to put a stop to the act of bribing officials from foreign countries as well as restori ng the confidence of the American investor in the integrity of the American business system and, has been amended twice in 1988 and in 1998 with the changing dynamics in businesses (Rutchfield and Lacey 2000). The U.K. Bribery Act 2010 Studies by independent audit firms such as Ernst & Young and Confronting Corruption show that firms and businesses in the United Kingdom have been making tremendous losses due to corruption and bribery. These are termed as barriers to growth and trade and overseas corruption makes it even harder and expensive do businesses abroad. The United Kingdom government has therefore strengthened its laws by enacting the Bribery Act 2010 that came into operation on July 1, 2011 creating a number of offences relating to corruption in international businesses. This law outlawed the bribing of a foreign official, giving, or promising an advantage when dealing with international business transactions (De Jonge 2011, p. 136). The U.K. Bribery Act 2010 also created a n offence of acceptance, demanding, or assenting to receive an advantage or benefit or failing to stop a bribe from being paid on behalf of a firm or a company. Case Study Analysis of the Celebratory Dinner Request under UK Bribery Act and FCPA Public/private sector The FCPA prohibits giving of bribery only to foreign public officials; on the other

Communism in North Korea Compared with Russia Essay
Communism in North Korea Compared with Russia - Essay Example It seems that for many practical purposes, the evolution of the socialist state in Russia made the Russian Socialist or Communist State assume the characteristics of a capitalist or free market or competitive market state. It is highly that capitalism the competitive market system was restored in Russia. III. The Communism of North Korea North Korea describes her communism as founded on the so-called ââ¬Å"immortal Juche Ideaâ⬠developed by Kim Il Sung. Kim Il Sung started developing the Juche idea during the North Korean struggle against Japanese invasion in World War II (ââ¬Å"Constitution of the Peopleââ¬â¢s Democratic Republic of Korea of 1998,â⬠3rd paragraph, Preface). The Juche Idea is the ideological foundation of North Korean communism and socialist ideals. North Korean communists consider that it is their task to remodel Korean society along the ideals of the Juche Idea founded by Kim Il Sung (Korean Friendship Association 1). In the view of North Korean comm unists, ââ¬Å"only when one is firmly armed with the Juche Idea and advances under its banner, would it be possible to emerge victorious in revolution and construction, surmounting all difficulties and trialsâ⬠(Korean Friendship Association 2). From the perspective or propaganda of North Korean communism among themselves, the Juche Idea is the conviction that the North Korean people has ââ¬Å"acquired through the history of revolutionary struggle spanning over half a centuryâ⬠(Korean Friendship Association 2). Like other communist parties and movements, the Juche Idea adheres to Marxism-Leninism (Korean Friendship Association 2). In particular, the Juche Idea adheres to a typical communist notion that ââ¬Å"Lenin developed Marxism and... Based on this research, socialism is a first stage of communism. In socialism, the rule is to each according to his work while in communism or the rule is ââ¬Å"to each according to his needs, from each according to his ability.â⬠Through the years, however, socialist regimes were confronted with various challenges to modify policies. The main differences between North Korean and Russian Communism are as follows. First, North Korean Communism has explicitly considered itself independent from the Marxist-Leninist ideology through the Juche idea while it is not clear whether Russian Communism has continued to adopt the Marxist-Leninist concepts of a state, socialist society, and communist ideology. Second, the North Korean economy appears to be closer to the traditional notion of a socialist state compared to Russia. Third, private enterprise and private property appears to be more restricted in North Korea compared to Russia. Fourth, North Korean communist ideology uses the Juch e rather than Marxism-Leninism. North Korean Juche is basically socialist/communist ideology but with this twist: North Korean communist ideology has more rhetoric on humanism, independence, and humanity as the center of the Juche ideology. Fourth, North Korean communism or socialism appears to be more restrictive against private property while it does not seem to be case for Russian communism or socialist. Finally or fifth, unlike other communists, North Korean communism focuses on a claim to socialism that is more humanity centered. Unfortunately, however, it is currently the socialist or communist country with the greatest nuclear ambitions.

Racial Diversity Essay Example | Topics and Well Written Essays - 750 words
Racial Diversity - Essay Example Furthermore, Farley (2005) argues that Dave Chappelle deals with racial divisions by confronting his audience with it in a comedic way. Consequently, his audience laughs at the use of racial stereotypes in his jokes, but the issue of racial divisions is talked about and not ignored. The thesis of this paper is that the use of racial stereotypes in comedy shows, such as ââ¬Å"The Chapelle Showâ⬠helps to overcome them. It might seem as if the use of stereotypes actually perpetuates them, because stereotypes are repeated on a regular basis. However, it is important to note that although stereotypes are repeated in certain comedy shows, it is not necessarily negative, because it helps us to deal with the issue and thereby overcoming racial tensions. Racial stereotypes are used frequently by various comedy shows, such as the ââ¬Å"Chappelle Showâ⬠, however, the use of them in a comedy setting helps us, as a society, to approach the issue. For instance, from an educational point of view, the fact that the topic has been dealt with in school, supports that thesis. On the one hand, we are repeating stereotypes by talking about them, but on the other hand, we are dealing with the topic of racial division, which will help us to overcome them in the long run. Dave Chappelleââ¬â¢s show was wildly known for the use of the ââ¬Å"Nâ⬠word, which is a term that is not politically correct. By using stereotypes and a certain vocabulary which is often not socially accepted, the audience is confronted with a topic that many people prefer to ignore: racial issue in America. The show became very popular and as a consequence, many people were confronted with the issue and dealt with stereotypes and racial divisions. Moreover, the media picked up the controversial topic as well and dealt with the implications. It is probably fair to say that ââ¬Å"Chappelleââ¬â¢s Showâ⬠took away the ââ¬Å"scarinessâ⬠of the topic, which made it more
